Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return & Refund Policy. We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made.

12. Disclaimer of Warranties; Limitation of Liability

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free. We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable. You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

13. Indemnification

You agree to indemnify, defend and hold harmless APEXRISE S.R.L. and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

14. Severability

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

16. Entire Agreement

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and govern your use of the Service.

17. Complaints & Warranties

We stand behind the quality of every piece of jewelry we sell. If you have a complaint or believe your item is defective or not as described, please contact us within 14 days of receiving your order.

How to submit a complaint:

  • Email us at support@cirrivo.com with your order number, a description of the issue, and supporting photos
  • We will acknowledge your complaint within 2 business days and aim to resolve it within 14 business days

Warranty coverage:

  • All jewelry items are covered by a 6-month warranty against manufacturing defects from the date of delivery
  • The warranty covers defects in materials and workmanship under normal use conditions
  • The warranty does not cover damage caused by misuse, accidents, improper care, normal wear and tear, or unauthorized modifications
  • If a valid warranty claim is approved, we will repair, replace, or refund the item at our discretion

18. Right of Withdrawal (Cooling-Off Period)

If you are a consumer residing in the European Union, you have the right to withdraw from your purchase contract within 14 days without giving any reason, in accordance with EU Directive 2011/83/EU on consumer rights.

Withdrawal period: The 14-day withdrawal period begins on the day you (or a third party designated by you) receive the goods.

How to exercise your right of withdrawal:

  • Notify us of your decision to cancel your order by sending a clear written statement to support@cirrivo.com prior to the expiry of the withdrawal period.
  • You may use the following model withdrawal form (not mandatory):
    "I/We hereby give notice that I/We withdraw from my/our contract of sale of the following goods: [order number / product name], ordered on [date], received on [date]. Name: [your name]. Address: [your address]. Date: [date]."

Effects of withdrawal:

  • We will reimburse all payments received from you, including standard delivery costs, without undue delay and no later than 14 days after we receive notification of your withdrawal
  • Reimbursement will be made using the same payment method you used for the original transaction
  • You must return the goods to us without undue delay and no later than 14 days after notifying us of your withdrawal
  • You bear the direct cost of returning the goods
  • You are only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods

Exceptions to the right of withdrawal: The right of withdrawal does not apply to goods that are made to your specifications or clearly personalized (e.g., custom-engraved jewelry), or to sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery (e.g., earrings).

19. Governing Law & Dispute Resolution

These Terms of Service and any separate agreements under which we provide you with Services shall be governed by and construed in accordance with the laws of Romania, excluding its conflict of law provisions.

Dispute Resolution:

  • In the event of any dispute arising out of or in connection with these Terms of Service or your use of our store, we encourage you to first contact us directly at support@cirrivo.com to seek an amicable resolution
  • If a dispute cannot be resolved amicably within 30 days, it shall be subject to the exclusive jurisdiction of the competent courts of Bucharest, Romania.
  • If you are an EU consumer, you also have the right to use the European Commission's Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr

20.Geographic Restrictions and Sanctioned Regions

Cirrivo does not sell goods, deliver shipments or provide services to any individuals, entities or destinations subject to trade sanctions, export controls or other legal restrictions.

We do not accept orders from, or ship to, the following restricted countries or regions:

  • Russia
  • Belarus
  • North Korea (Democratic People's Republic of Korea)
  • Iran
  • Cuba
  • Syria
  • Sudan and South Sudan
  • Any other country, region, or territory subject to comprehensive international trade sanctions at the time of purchase

By placing an order on our website, you represent and warrant that: (a) you are not located in, or a resident of, any restricted country or region listed above; (b) you are not on any government list of prohibited or restricted parties; and (c) you will not use our products or services in violation of any applicable export control or sanctions laws.

We reserve the right to cancel any order and refund the payment if we determine, at our sole discretion, that the order originates from or is intended for delivery to a restricted region. We shall not be liable for any loss or inconvenience arising from such cancellation.
